Television and media industry are stuck in a wasteful rear-guard fight for the preservation of an analog era relic: the Release Windows system. Designed to avoid destructive competition among media, it ends up boosting piracy while frustrating honest viewers willing to pay.
A couple of months ago, I purchased the first season of the TV series Homeland from the iTunes Store. I paid $32 for 12 episodes that all landed seamlessly in my iPad. I gulped them in a few days and was left in a state of withdrawal. Then, on September 30th, when season 2 started over, I would have had no alternative to downloading free but illegal torrent files. Hundreds of thousands of people anxious to find out the whereabouts of the Marine turncoat pursued by the bi-polar CIA operative were in the same quandary (go to the dedicated Guardian blog for more on the series).
In the process, the three losers are:
– The Fox 21 production company that carries the risk of putting the show together (which costs about $36m per season, $3m per episode)
– Apple which takes its usual cut. (The net loss for both will actually be $64 since the show has been signed up for a third season by the paid-for Showtime channel and I wonder if I’ll have the patience to wait months for its availability on iTunes.)
– And me, as I would have to go through the painstaking task of finding the right torrent file, hoping that it is not bogus, corrupted, or worse, infected by a virus.
Here, we put our finger on the stupidity of the Release Windows system, a relic of the VHS era. To make a long story short, the idea goes back to the 80′s when the industry devised a system to prevent different media — at the time, movie theaters, TV networks, cable TV and VHS — from cannibalizing each other. In the case of a motion picture, the Release Windows mechanism called for a 4 months delay before its release on DVD, additional months for the release on Pay-TV, Video-On-Demand, and a couple of years before showing up on mainstream broadcast networks (where the film is heavily edited, laced with commercial, dubbed, etc.)
The Western world was not the only one to adopt the Release Window system. At the last Forum d’Avignon cultural event a couple of weeks ago, Ernst & Young presented a survey titled Mastering tempo: creating long-term value amidst accelerating demand (PDF in English here and in French here).
The graph below shows the state of the windows mechanism in various countries:
Europe should be happy when comparing its situation to India’s. There, it takes half a year to see a movie in DVD while the box-office contributes to 75% of a film’s revenue. Ernst & Young expects this number to drop only slightly, to 69%, in 2015 (by comparison, the rate is only 28% in the UK). Even though things are changing fast in India, internet penetration is a mere 11.4% of the population and movie going still is a great popular entertainment occasion.
In the United States, by comparison, despite a large adoption of cable TV, Blue-Ray or VOD, and a 78% penetration rate for the internet (84% in the UK and higher in Northern Europe), the Release Windows system shows little change: again, according to the E&R survey, it went from 166 days in 2000 to 125 days in 2011:
Does it makes sense to preserve a system roughly comparable to the one in India for the US or Europe where the connected digital equipment rate is seven times higher?
Motion pictures should probably be granted a short head start in the release process. But it should coincide with the theatrical lifetime of a production that is about 3-4 weeks. Even better, it should be adjusted to the box-office life — if a movie performs so well that people keep flocking to theaters, DVDs should wait. On the contrary, if the movie bombs, it should be given a chance to resurrect online, quickly, sustained by a cheaper but better targeted marketing campaign mostly powered by social networks.
Similarly, movie releases should be simultaneous and global. I see no reason why Apple or Microsoft are able to make their products available worldwide almost at the same time while a moviegoer has to wait three weeks here or two months there. As for the DVD Release Windows, it should go along with the complete availability of a movie for all possible audiences, worldwide and on every medium. Why? Because the release on DVD systematically opens piracy floodgates (but not for the legitimate purchase on Netflix, Amazon Prime or iTunes).
As for the TV shows such as Homeland and others hits, there is not justification whatsoever to preserve this calendar archaism. They should be made universally available from the day when they are aired on TV, period. Or customers will vote with their mouse anyway and find the right file-sharing sites.
The “Industry” fails to assess three shifts here.
–The first one is the globalization of audiences. Worldwide, about 360m people are native English speakers; for an additional 375m, it is the second language, and 750m more picked English as an foreign language at school. That’s about 1.5 billion people likely to be interested in English-speaking culture. As a result, a growing proportion of teenagers watch their pirated series without subtitles — or scruples.
–Then, the “spread factor”: Once a show becomes a hit in the United States, it becomes widely commented in Europe and elsewhere, not only because a large number of people speak serviceable English, but also because many national websites propagate the US buzz. Hollywood execs would be surprised to see how well young (potential) audiences abroad know about their productions months before seeing them.
–And finally, technology is definitely on the side of the foreign consumer: Better connectivity (expect 5 minutes to download an episode), high definition image, great sound… And mobility (just take a high-speed train in Europe and see how many are watching videos on their tablets).
To conclude, let’s have a quick look at the numbers. Say a full season of Homeland costs $40m to produce. Let’s assume the first release is supposed to cover 40% of the costs, that is $16m. Homeland is said to gather 2 million viewers. Each viewer will therefore contribute for $8 to the program’s economics. Compare to what I paid through iTunes: my $32 probably leave about half to the producers; or compare to the DVD, initially sold for $60 for the season, now discounted at $20. You get my point. Even if the producer nets on average $15 per online viewer, it would need only 1.6 million paid-for viewers worldwide to break-even (much less when counting foreign syndication.) Even taking in account the unavoidable piracy (which also acts as a powerful promotional channel), with two billion people connected to the internet outside the US, the math heavily favors the end of the counter-productive and honest-viewer-hostile Release Windows archaism.

I wish this were the case as well. However the real reason for withholding TV shows from OTT is to protect cable, which is a very lucrative and large revenue stream (we’re talking video ARPUs of $55-75/mo for 85-90% of U.S. households, and half of this is paid by MSOs for content costs).
You have a great point that the content guys are somewhat losing the forest for the trees, in that they are trying to withhold the TV shows from a potential global audience of 1.5-2b. I think this is because they want to build up outlicensing agreements over time with TV channels abroad (e.g. ProSieben in Germany licensing a bunch of CBS shows). The timeslot when the episodes actually air on foreign TV in each country is also at the mercy of say ProSieben, and then the time-lag after airing in the U.S. is based mostly on how much ProSieben is willing to pay CBS.
But here’s the problem with trying to create “artificial scarcity” by airing a show on U.S. TV then only appearing in Germany a week later (and in Chile maybe a month later): 1) some shows are now put onto iTunes immediately after airing. This shows consumers it’s clearly “possible” and maybe even “normal” to do this. For withheld shows like Homeland, it’s seen as patently unfair by international viewers. 2) People in the U.S. have inevitably encoded it in 720p or even 1080p, high-quality torrents and uploaded them to the global Internet, giving a very viable alternative. Heck, they’ve even subbed them into dozens of languages.
The content guys may be leaving a ton of international iTunes revenue on the table; they are DEFINITELY inculcating Torrenting as an acceptable practice among ages 10-30 in Europe, Asia, LatAm, etc. And yes, they are also building demand for legitimate outlicensing from channels in Australia, Europe, Asia, LatAm as well.
The problem is, o-U.S. pay-TV has much lower subscriber ARPU as well as significantly lower ad CPM. (And minutes of ads/show is lower in many foreign markets as well.) So the “potential” of revenue per viewer is significantly lower, especially when you consider that there is one more layer between the MSOs/advertisers and NBC or CBS – the foreign TV station. So we have much lower potential revenue per viewer, even in a “mature” environment (unless o-U.S. pay-TV ARPUs can double, double, and then double again). Thus I agree with you that the TV content guys’ conscious decision to withhold shows on international iTunes/PPV VOD is not too smart.
In the case of U.S. and Canadian viewers, the extremely high revenue/viewer cable universe – based on high sub ARPUs and high ad inventory per show at medium (high vs. o-U.S.) CPMs – that has emerged over the past 35 years is something the content guys regard as sacred and rightly so. Where they haven’t (e.g. the former Netflix/Starz streaming deal), visions of cord-cutting have quickly scared them straight. The ad revenue component – again, U.S. ad inventory is insultingly high to someone paying $65/mo for cable, but we Americans are acclimated to it – is important here: iTunes downloaders pay $1-3/show but don’t get any ad revenue with that. Apple’s take of ARPU is only 30% vs. ~50% for the MSO though, so it makes up for zero ad revenue somewhat…
In India the crowd likes to go to theaters because there they are treated with a lot of attentions by the crew and often the place has a better conditioning system than their home.

You still have the perfectly good alternative of waiting until the release date on DVD. This is completely childish posture, don’t try to describe it as if someone is forcing you to do the wrong thing: you are doing it because you really want.

Also, Frédéric, you must stop touching yourself. The priests would be very unhappy, the high road would remain untrodden, and the ultimate human need of quick satisfaction (of which the entertainment industry IMO encourages) would be unrealized.
the cost of production is not only recouped but exponentially multiplied based on the advertising that is shown during the show. when a popular show is sold overseas it will demand more from advertisers to show their advertisements during the airing. your calculations dont take this profit money in to account.
The issue with your thesis is that the people like you that want to PPV do not generate as much revenue as the MVPDs pay + Int’l distribution, so that is why PPV is a downstream window.
I agree with the article in principal, but agree with most of the comments in practice. On the subject of staggered movie releases, I believe the reason for that is promotion – the want to drag their stars around the world to appear on talk shows, etc around the time of the local release.
I used to have the view that this was ridiculous and unfair, but now I’ve come round to the idea that:
a) Hollywood knows what it’s doing (vs most other movie producing markets that don’t actually make much I want to see).
b) Watching movies is not a human right… talented people spend a lot of money on putting them together, and they’re pretty talented in extracting the maximum possible revenue. I can’t honestly fault that, even if it means I have to wait 6 months to see their output.
To those urging FF to wait and “Watching movies is not a human right” — the genie can not be put back in the bottle, and people seeing that they can legitimately get The Good Wife or Mad Men on iTunes 24 hours after they air are really not very interested in Showtime’s business model or appeals to morality. They will download without paying, period.
That said, yes, the reason Homeland isn’t being released on time, is the pay cable business model which would collapse if people could get individual shows through iTunes. From the producers standpoint, going direct to iTunes/DVD doesn’t work because they depend on the promotion, visibility and upfront cash they get from the cable guys. If Homeland had been released direct to iTunes, FF probably would not have heard of it or be watching it…
The real issue is why we have “tv seasons” at all. They’re just a leftover from the auto industry who liked to introduce their new cars every fall and used new TV show sponsorship to promote the new cars. This tie-up slaving TV to car sales stil exists for few good reasons, mostly because few are willing or able to change it, and because we viewers have come to accept this seasonal thing or don’t even understand why it is the way it is. You complain about Homeland taking a day to hit iTunes -the show was probably made and “in the can” months earlier so really, why did anyone have to wait for a network to show it? Why not release when ready? Movies now get routinely held for 9-12 months to hit certain holidays and it’s the same thing: the public is just made to wait. Hollywood should be damn proud so many people bother to wait for their products -and sobered by the realization that the people are slowing getting wise to and no longer as eager to just wait for what they want.
I agree in principal, but I’d concede to having a 24-hour waiting period to buy TV-series episodes, if only to let it air at peak viewing hours worldwide before I can buy it.
However, I should be able to rent TVs and movies as they are aired or played in the theater, but at a very high markup during the first few weeks of a movie or first day of a TV episode. By “very high” I’m talking a 1-week rental for 2-3x the price of a movie ticket or 2x+ the per-viewer ad revenue, capped at 75% of the “estimated first-week street prices” sale price of the show or movie when it becomes available a week or a month later.
Would I pay such outrageous prices to rent a TV show or movie on “day one”? Probably not, but a lot of people I know would do so if they missed their chance to record it or they didn’t have time to go to the theater.
I MIGHT rent a movie or TV show at that price if I got most of that money back in discounted movie tickets or a coupon for purchasing the movie or the TV show later. For example, if I had little kids I might rent a first-run movie on release day for $25 and use the $20 coupon that comes with it to go see it at the theater when the crowds thinned out or use the $20 toward the Blue-Ray version when it came out a month later.
It is worth looking more closely at how this type of entertainment is financed.
My (admittedly dated understanding), is that films are financed in part, by selling options on the cable, broadcast, home video and international rights. The buyers of the options would see how the film did in initial release before deciding whether to pony up even more money to exercise their option.
With simultaneous global release, the risks can’t be managed the same way.
This is actually an area I think Apple is well positioned to consolidate a strategic position. They already have better global digital distribution than just about anyone, and they have the capital to buy a lot of influence. I don’t know for sure, but I suspect the total working capital at play in the production of movies and TV is relatively modest compared to Apple’s cash pile. If they took some of that money and made it available to finance TV and movies, in exchange for favorable worldwide distribution rights (and a piece of the profits), they could reshape the industry in the favor of themselves and their customers, while turning a modest (additional) profit.
Interestingly enough, Homeland Season 2 is available via iTunes here (Germany). Episodes become available “as they air”. Convinced me to switch from Torrent to iTunes (better download rate, legitimate source, no worries with desynched vid and audio, etc.).
This goes right up there with people that say that there should be class-action lawsuits for every bug in software ever created. People should ship software without of bugs, for crying out loud! Such a fundamental shift in priorities would leave Silicon Valley penniless. You can’t capture the same kind of value if you use somebody else’s idea of what your business model should be.
Another reason for the release windows is that the studios distribute and own the worldwide rights to the films / series themselves. Cash flow wise movie production is horrible, all the cost and risks are upfront.
Think about the cost of a worldwide marketing campaign for a film that flops compared to only doing intensive marketing in the US and maybe some small markets. By releasing in only one or a select few markets it is much easier to understand how much one should spend on marketing in other markets.

Nice article, but I think the data for India is inaccurate. I recently saw that a big budget Bollywood movie (Ek Tha Tiger) which got released on 15th August, 2012, the DVDs came out on 1st October 2012 (in 45 days or so). It is also available for purchase on the newly launched itunes.
